Shared Fault Rules

There are instances were you file a claim against someone and they try to argue that you are also in some part responsible for the accident. If you are found to be in some part liable for the accident it can affect the amount of compensation that is awarded to you. In Texas there is a “modified comparative negligence rule”, which says that the amount of compensation that you will received will be “reduced by an amount that is equal to your percentage of fault” (AllLaw.com). However if you are found to be more than 50% liable of the accident you can not receive any compensation.
